Mayor announces appeal court ruling in favor of Town and Margaritaville


Mayor Ray Murphy today announced the results of a court ruling in favor of the Town of Fort Myers Beach and TPI Hospitality that confirmed that the Town adhered to its regulations and resolves the procedural impediment to the Margaritaville Resort construction project.

Today’s ruling announcement confirmed a previous legal decision in favor of the Town regarding a claim that sought to stop the resort project. The project was initially approved by Town Council and the Local Land Planning Agency in 2018. With this ruling, the Town has prevailed in two court decisions on this matter.

"It is my pleasure to announce that, this morning, we were informed of the ruling by the 2nd District Court of Appeals that is in favor of the Town of Fort Myers Beach and TPI Hospitality (a.k.a. Margaritaville),” said Mayor Murphy. “We as a community are pleased that the 2nd District Court of Appeals agreed with the Circuit Court that the Town of Fort Myers Beach did indeed follow its own codes. After this long-drawn-out process, we can now look forward to the redevelopment of the north end of our island,” said Mayor Murphy.
